Clover Files Emergency Motion in Canon Lawsuit
On May 30, 2012, respondents Clover Holds, Inc.; Clover Technology Group, LLC; Clover Vietnam Co., Ltd.; Dataproducts USA, LLC; and Dataproducts Imaging Solutions S.A. de C.V. filed an emergency motion to the United States District Court for the District of Columbia to issue a commission to take depositions of 25 Canon employees, previous Canon employees and individuals who were involved in the inventions, prosecutions or reexaminations of two patents at issue in this investigation, U.S. Patent Nos. 5,903,803 and 6,128,454.
Clover believes each of these individuals has relevant information and knowledge of important facts related to this investigation.
Although Canon reserves the right to object to the production of specific deponents, the OEM has not opposed the filing of this motion.
According to the filing, all depositions must take place from July 23 to August 17 at the Consulate General of the United States at Tokyo or Osaka-Kobe, Japan.
Although several companies named in this lawsuit have agreed to consent judgments and permanent injunctions, it seems Clover isn’t quite ready to give in. For the moment, the aftermarket giant is preparing to defend its products.
