Ninestar Products Can Be Sold Legally in Germany

Pearl Agency has received a favorable result in its lawsuit against Brother in Germany. Dusseldorf District Court has cancelled the preliminary injunction on Brother LC980 series ink cartridge from Pearl Agency- Ninestar’s patented cartridges are available again in the German market.

On May 20th, 2011, Brother accessed to the court for preliminary injunction to Pearl Agency, patents DE20 2008 018 039U1 and DE20 2008 018 040U1, which both claim connections transferring the information related to the ink and ink cartridge to the printer are involved. The preliminary injunction was issued by Dusseldorf Court toward the end of July.

Pearl Agency acted positively to appeal and provide technical evidences to prove Ninestar’s patented products were non-infringing. After six months of great effort, the Dusseldorf District Court has made a final judgment to cancel the preliminary injunction.

Pearl Agency and Ninestar indicate that they will always respect the intellectual property of the other companies and stand against any abuse of IP.
